Terms of Use for AMFA Manager

Access to and use of this site ('amfa-manager.com') and the AMFA Manager game contained within is provided by Liger Software Ltd subject to the following Terms:

You agree to be legally bound by these Terms, which shall take effect immediately on your first use. If you do not agree to be legally bound by all of the following Terms, please cease use of this site immediately.
Liger Software Ltd may change these Terms at any time by posting changes online. Please review these Terms regularly to ensure you are aware of any changes made. Your continued use of amfa-manager.com after changes are posted means you agree to be legally bound by these Terms as updated and/or amended.
For the purpose of these Terms, the expression 'AMFA MANAGER' shall represent both the AMFA Manager game, and the website amfa-manager.com on which it is hosted.
Use of AMFA Manager
1. The entire contents of AMFA MANAGER are copyright of Liger Software Ltd. You may not copy, modify, publish, transmit, reproduce, adapt, create derivative works from, translate, decompile, disassemble, reverse engineer, make available to the public, or otherwise use amfa-manager.com content in any way except for your own personal, non-commercial use.
2. You agree to use AMFA MANAGER only for lawful purposes, and in a way that does not infringe the rights of others. This includes restricting or inhibiting anyone else's use and enjoyment of AMFA MANAGER. Prohibited behaviour includes transmitting obscene or offensive content, harassing, or causing distress or inconvenience to any person.
3. Only one AMFA MANAGER account may be registered per person.
4. Users of AMFA MANAGER must login to the game at least once every 30 days in order to keep their account active. Any user inactive for a period of longer than 30 days will be liable to be removed from their club. A further 30 days will be given for a user to then withdraw any funds owing to them, after which they will be liable to have these funds voided and their accounts permanently deleted.
5. The deliberate release of AMFA MANAGER players by a user, or the coercion or encouragement of other users into releasing players for the benefit of another club, the detriment of a club, or to bypass any transfer fees, is prohibited.
  Any users involved in such activity are liable to have their accounts deleted or suspended, and the consequences of their actions reversed within AMFA MANAGER.
6. Liger Software Ltd reserves the right to bar users from AMFA MANAGER, on a permanent or temporary basis at our discretion. Any such user shall be notified, and must not then attempt to use AMFA MANAGER under any other name or through any other user. Any money legitimately owing to such users will be refunded by Liger Software Ltd by cheque payable to the name given at the time of registration, less a .50 GBP charge.
7. Use of AMFA MANAGER may be prohibited in your jurisdiction. AMFA MANAGER is not intended for and is not available to persons in jurisdictions where the use of internet applications and participation in prize competitions is, or may be deemed to be, prohibited. By registering to play AMFA MANAGER you warrant that there are no legal or other restrictions or prohibitions on your use of internet applications and participation in prize competitions, and that you have the full, complete and unrestricted legal right to participate in AMFA MANAGER.
8. Users must be at least 18 years of age or the age of majority in the country in which they are resident. Any transactions carried out by minors will be considered null and void and no money will be paid out. Liger Software Ltd reserves the right to request proof of age at any time. It is your responsibility to determine what the legal age of majority is in your jurisdiction.
Personal Information
1. To register for AMFA MANAGER you need to supply your name and address, as well as manager's name (which may be a pseudonym). You will also need to choose a username and password.
  Your pseudonym and username will be available to other users of AMFA MANAGER for the purpose of facilitating communication between players for the enhancement of the game, but only within the secure confines of the game itself.
  
  All other personal information will not be available to other users.

3. Providing false information may lead to the suspension or termination of your account.
4. Users must keep their password confidential.
Disclaimers and Limitation of Liability
1. All content of AMFA MANAGER is supplied free of any access charge and on the basis of no liability for the information given. Liger Software Ltd does not warrant that functions contained in AMFA MANAGER content will be uninterrupted or error free, that defects will be corrected, or that AMFA MANAGER or the server that makes it available are free of viruses or bugs.
2. Liger Software Ltd reserves the right to cease to make AMFA MANAGER available to users on a permanent basis at any time, and without prior warning. In this instance, any money legitimately owing to users will be paid out according to the balance of their account at this time.
3. In no event shall Liger Software Ltd be liable for any direct or indirect or consequential loss, loss of profit, revenue or goodwill arising from use of AMFA MANAGER or information contained within it. All Terms implied by law are excluded. Nothing in these Terms shall exclude or limit Liger Software Ltd's liability for death or personal injury caused by negligence, or its responsibility for fraudulent misrepresentation that cannot as a matter of English law be excluded.
4. Any views, opinions, or other information or content expressed or made available by users, are those of the authors, and not of Liger Software Ltd. Liger Software does not necessarily endorse nor is responsible for the accuracy or reliability of any opinion, advice or statement made on AMFA MANAGER.
5. Liger Software Ltd reserves the right to change the rules or the nature of AMFA MANAGER on a permanent or temporary basis at any time, and without prior warning.
6. All player, stadium, and team names found within AMFA MANAGER are fictitious and any resemblance between these and players, stadiums, or teams past or present associated with the English or any other Football Association or Federation is purely coincidental.
Prizes and the Game
1. Success within the game is dependent upon winning matches. In compliance with section 14 of the Lotteries and Amusements Act 1976, this depends to a substantial degree on the exercise of skill.
2. No purchase is necessary to play AMFA MANAGER. Every participant must be a registered user.
3. Employees and immediate relatives of employees of Liger Software Ltd or of any competition sponsors and/or prize providers may not register/purchase teams and are therefore not eligible to enter any prize competitions.
  AMFA MANAGER administrators may occasionally need to create a team or manager for testing or security purposes, in this instance they will not eligible for any prize competitions.
4. Prize money for competitions is subject to change to be Liger Software Ltd at any time, and without any prior notice. The current amount will be advertised within AMFA MANAGER in the information page for the specific competition, and is stated in game money.
5. Users are responsible for any tax payable as a result of receiving money from AMFA MANAGER.
6. When resigning from or selling a team, or in the instance of your account being suspended, you give up all ownership of that team and its assets.
  When buying a team you will become the owner at the time of sale, and will have sole control over its assets, in accordance with the rules and workings of the game.
  All teams (and their assets) without human managers are owned by Liger Software Ltd.
Payments to Liger Software Ltd
1. Payments to Liger Software Ltd will be accepted via Nochex, Paypal, and cheque or postal order (in pounds sterling) only.
2. The minimum deposit is 5 GBP, and the maximum is 100 GBP at any one time.
  Nochex or Paypal may impose their own limits, depending on whether you are a registered user. It is your sole responsibility to ensure your participation in AMFA MANAGER complies with their terms and conditions.
3. There is no requisite for money to be deposited once a team has been purchased or created.
  However, your account must be in credit or an accepted payment have been made to Liger Software Ltd (within the last 30 days) at the end of each calendar month.
  Failure to meet either criteria for 3 months in a row will mean you will be resigned from your team.
4. Money uploaded will be converted into a value in game money according to the fixed exchange rate for deposits. Liger Software Ltd reserves the right to change this rate at any time.
Payments from Liger Software Ltd
1. Money withdrawn from the game will be converted into a value in GBP from game money according to the fixed exchange rate for withdrawals. Liger Software Ltd reserves the right to change this rate at any time.
2. The minimum withdrawal is 10 GBP, or the total balance of your account providing it is at least 1 GBP.
  Payments may be made in instalments in order to comply with Nochex policy.
3. Payments by Nochex are Liger Software Ltd's preference for UK residents, and the only available form of payment for non-UK residents. Users must be registered with Nochex to receive payment, which will be sent only to the email address registered by this user.
  Payments to users by cheque will be made out to the name given at the time of registration, and are only available to UK residents (cheques will be in pounds sterling, less a .50 GBP charge).
  Liger Software Ltd will only make payments to the registered user, and appropriate identification and documentation may be required by Liger Software Ltd before any payment is made.
4. Payments will only be made by cheque if they total more than .50 GBP, and will be made by Nochex in compliance with their own policy.
5. Liger Software Ltd reserves the right to withhold payment from users who do not comply with the Terms.
6. Payments will be made within 28 days of receipt of valid identification from the registered user. Liger Software Ltd reserves the right to withhold payment for longer than 28 days whilst any investigation into an allegation or suspicion of a breach of the Terms is carried out.
7. Users leaving the game with a debt, and returning with a new account will be liable to have that debt transferred to their new account.
  Liger Software Ltd will maintain records of all transactions within AMFA MANAGER.
8. Money cannot be refunded once uploaded. However, the remaining balance of accounts will be paid out upon request. Payments will be made by Nochex, or cheque only. Liger Software Ltd will not make payments in cash or any other form.
9. Liger Software Ltd reserves the right to credit or debit accounts to rectify any transactions made in error or in cases resulting directly or indirectly from a user contravening the Terms.
  Cancellation or reversal of any transactions is at the sole discretion of Liger Software Ltd.
AMFA Manager Forum
1. When registering an AMFA MANAGER account users will automatically be eligible to use the forum.
  Registration to the forum is at the sole discretion of Liger Software Ltd and users will not be able to register an account on the forum in any other way.
2. By agreeing to these Terms, you also agree to be bound by the terms of the forum which are as follows:
  "While the administrators and moderators of this forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. Therefore you acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster (except for posts by these people) and hence will not be held liable.
  
  You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions. You agree that the webmaster, administrator and moderators of this forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.
  
  This forum system uses cookies to store information on your local computer. These cookies do not contain any of the information you have entered above [username, email, and password]; they serve only to improve your viewing pleasure. The e-mail address is used only for confirming your registration details and password (and for sending new passwords should you forget your current one)."
3. Any content (text, images etc.) posted to the AMFA Manager Forum is considered a Contribution to AMFA Manager (see below).
Contributions to AMFA Manager or Liger Software Ltd
1. Liger Software Ltd welcomes any submissions regarding AMFA MANAGER, either made as part of participation in the game, or for its improvement or enhancement.
  You agree, by submitting your contribution, to grant Liger Software Ltd an exclusive, perpetual, royalty-free, sub-licensable right and license to use, reproduce, modify, adapt, publish, distribute, make available to the public, and exercise all copyright with respect to your contribution worldwide. You agree to waive any moral rights in your contribution, including the right to be identified as author of the contribution.
  If you do not want to grant to Liger Software Ltd the rights set out above, please do not submit any contributions.
  By submitting your contribution you warrant that it is your own original work, that you have the right to make it available to Liger Software Ltd for all the purposes specified above, and that it does not infringe any law.
Jurisdiction and Law
1. These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and any dispute arising out of any act or contract to which these Terms apply shall be subject to the exclusive jurisdiction of the English Courts.
General
1. You must indemnify Liger Software Ltd against all legal fees, damages and other expenses that may be incurred by Liger Software Ltd as a result of your breach of this provision, or any other provision of the Terms. This shall include (but not necessarily be limited to) any action taken either by or against you that might arise as a result of the illegality of the use of AMFA MANAGER within your jurisdiction.
2. Failure by Liger Software Ltd to enforce a right does not result in waiver of such right.
3. You may not assign or transfer your rights under this agreement.
